Monarch Upcycle Challenge Terms and Conditions

HOW TO ENTER:

The rules of the competition and how to enter are as follows:

Take a photograph or video of how you have re-used/upcycled the packaging from a Monarch Nucleic Acid Purification Kit. Post your video or photograph to Facebook, Twitter or Instagram using #NEBMonarchUpcycle and tagging New England Biolabs in the photo (@NEBiolabs). NEB will then contact you via direct message to request your contact information so that we may notify you if you are selected to win the Prize.

ELIGIBILITY: No purchase necessary to participate. This promotion is open only to life science professionals 21 years and older who reside anywhere outside of The People’s Republic of China. Eligible participants who post a video or photograph of a way in which they re-use a Monarch Nucleic Acid Purification Kit box/packaging to Facebook, Twitter or Instagram, using #NEBMonarchUpcycle and tagging @nebiolabs no later than 8:00 p.m. US Eastern Time on June 30 or such later date if the promotion end date is extended by NEB, and who agree to be bound by the Terms and Conditions of Promotion, may enter.  Limit five (5) submissions per person. Healthcare Professionals may not participate in this promotion. The term Healthcare Professionals includes individuals (clinical or non-clinical physicians (MDs and MDs/Ph.D.s), physician assistants, nurses, technicians, research coordinators, administrators and purchasing personnel) and entities (including hospitals, rehabilitation centers, nursing facilities, home health agencies, clinics and group purchasing organizations, managed care organizations, physician group practices, medical directors for health insurance organizations) and their employees and representatives who are involved in the actual provision of health care services.

Government Officials in Europe may not participate in this promotion. Government Official shall mean: (i) any officer or employee of a government or any department, agency or instrument of a government; (ii) any person acting in an official capacity for or on behalf of a government or any department, agency, or instrument of a government; (iii) any officer or employee of a company or business owned in whole or part by a government; (iv) any officer or employee of a public international organization such as the World Bank or United Nations, the European Union or the World Health Organization; (v) any officer or employee of a political party or any  person acting in an official capacity on behalf of a political party; and/or (vi) any candidate for political office.

By accepting a prize, participants represent that they are not prohibited by law, regulation, or agency/institutional policy from receiving the gift from New England Biolabs, Inc. (“NEB”). This promotion cannot be combined with any other discounts or promotions. Offer void where prohibited, licensed, or restricted by federal, state, provincial, or local laws or regulation or agency/institutional policy. Other restrictions may apply. Determination of eligibility and validity of participant responses is at NEB’s’ sole discretion. Each participant is deemed to be the owner of the email or social media account through which the entry into the promotion was made.

DURATION: This promotion ends on June 30 at 8:00pm U.S. Eastern Standard Time, unless extended by NEB in its discretion (“Promotional Period”).

DONATION: For each of the first 350 valid entries into this Promotion, NEB will donate $10 to the Monarch Joint Venture http://monarchjointventure.org/, managed by the University of Minnesota.  

PRIZE: The selected winner will have the choice to receive either (a) $1000 in NEB product credit; OR (b) a $1000 gift card to justgive.org to donate to a charity of choice (each referred to as the “Prize”).  The NEB product credit must be used by December 31, 2017. The Prize winner is responsible for all applicable taxes.

WINNER: One winner will be selected to receive the Prize. The Prize is not transferable. NEB reserves the right to substitute the Prize with another of equivalent value without giving notice. NEB employees and their families are not eligible to win the Prize. The winner will be chosen by an impartial panel of judges comprised of NEB employees, based on the following criteria:

  • Creativity (30%)
  • Utility/Application (whether your re-use is something other people can use) (30%)
  • Originality (20%)
  • Complexity/Level of Detail (10%)
  • Humor/Wit (10%)

The winner will be notified by email or letter within 30 days of the closing date of the promotion. If the winner cannot be contacted or does not claim the Prize within 14 days of notification, NEB reserves the right to withdraw the Prize from the winner and pick a replacement winner. NEB’s decision as to the selection of the winner is final. The winner’s name will be available 30 days after closing date.  Questions or comments can be sent to monarch@neb.com.

RIGHT TO USE ENTRIES: Promotion participant entry details, including but not limited to videos, posts and photographs, may be used by NEB for promotional purposes.  By entering the promotion, you grant NEB a perpetual, non-exclusive, royalty free and transferable license to use and reproduce any photographs, media coverage or other promotional material relating to your entry into this promotion.

OTHER TERMS: This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter or any other Social Network. The information provided will be used in conjunction with the following Privacy Policy found at https://www.neb.com/privacy-policy

NEB shall have the right, at its sole discretion and at any time, to change or modify these Promotion Terms and Conditions, such change shall be effective immediately upon posting to this webpage. NEB also reserves the right to cancel the competition in its sole discretion.

GOVERNING LAW.  This offer is void where prohibited by law. Any dispute arising out of this promotion will be governed by the laws of the Commonwealth of Massachusetts, without regard for its conflicts of law provisions.

IN NO EVENT SHALL NEB BE LIABLE, WHETHER IN CONTRACT, TORT, WARRANTY, OR UNDER ANY STATUTE OR ON ANY OTHER BASIS FOR SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, MULTIPLE OR CONSEQUENTIAL DAMAGES SUSTAINED BY ANY PARTICIPANT OR ANY OTHER PERSON OR ENTITY ARISING OUT OF THIS PROMOTION, USE OF AN NEB PRODUCT OR PRODUCT BOX, NEB’S PERFORMANCE OR FAILURE TO PERFORM ITS OBLIGATIONS RELATING TO THE PROMOTION, WHETHER OR NOT FORESEEABLE AND WHETHER OR NOT NEB IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES ARISING FROM OR RELATED TO LOSS OF USE, LOSS OF DATA, DOWNTIME, OR FOR LOSS OF REVENUE, PROFITS, GOODWILL, OR BUSINESS OR OTHER FINANCIAL LOSS.
